In brief

The Environmental Protection Agency's recent court filing signals a significant policy shift regarding chemical facility regulations, proposing to end enhanced safety protocols enacted by the previous administration.

The Trump administration is set to rewrite vital safety regulations designed to prevent chemical disasters, as announced by the Environmental Protection Agency (E.P.A.) this week. The recent court filing indicates a move to rescind the rules instituted under President Biden, which took effect in May. These regulations mandated that thousands of hazardous-chemical sites implement new safety measures to address risks associated with climate change, including storms and floods. In addition, the Biden-era rules urged facilities to evaluate the use of particularly hazardous chemicals and consider switching to safer alternatives, along with requiring enhanced communication with local communities and emergency responders. Facilities with records of past accidents were also obligated to undergo independent safety audits to ensure compliance with the new measures. The E.P.A.'s proposal to rewrite these regulations comes largely in response to a legal challenge led by Republican Attorneys-General and major players in the chemical industry, who contended that the Biden administration's safety rules imposed excessive burdens without delivering substantial safety benefits. The American Chemistry Council, the main industry group involved in the lawsuit, has yet to respond to the proposed changes.Earthjustice, a prominent environmental law organization known for its advocacy, criticized the administration's approach, emphasizing the dire consequences of chemical explosions, including potential evacuations and risks to first responders' lives. Attorney Adam Kron expressed concern, stating that inadequate safety measures put workers at risk, leading to serious injuries and even fatalities due to negligence by companies trying to save costs.
