Judge Rules Trump Administration Retaliated Illegally Against AI Startup Anthropic

In a striking court ruling, U.S. district Judge Rita Lin declared that the Department of Defense’s decision to label artificial intelligence company Anthropic a supply‑chain risk was unlawful and unfounded. The judge said calling national security a “blank check” does not grant the government the right to retaliate against companies that refuse to comply with military requests.

Anthropic sued after the Pentagon, under Defense Secretary Pete Hegseth, designated it as a risk in February, a status usually reserved for firms in countries deemed hostile to the United States. The designation came after Anthropic declined to allow its AI models to be used for surveillance or autonomous weapons, citing safety and privacy concerns.

The judge explained that the government’s attempt to “cripple” the company and silence discussions about AI's military use amounted to classic First Amendment retaliation. Anthropic welcomed the ruling, emphasizing the firm’s commitment to working with the government to safely apply AI technology for national security.

The Pentagon’s move marked the first time an American firm has been publicly flagged as a supply‑chain risk, raising questions about the scope of executive power in technology regulation. While the White House dismissed Anthropic as “radical left, woke,” the court’s decision reaffirms limits on retaliation against companies exercising free speech.
